NSW eases drug laws with fines instead of convictions

      The NSW government is overhauling its drug laws and under the changes, police will be given the power to issue on-the-spot fines for small amounts of drugs instead of charging people with a crime.

      This will not apply to any serious drug offences such as supply.

      The scheme was designed to encourage people who are fined to complete a drug and alcohol intervention, and if they complete it, then their fine is waived. If not completed, the fine stands.

      The new laws are designed to divert thousands of people away from the court system.

      Minister for Health Ryan Park said was not mandatory for the Police to issue an on-the-spot fine.

      “This is another tool in their kit and police retain their discretion to deal with the matter as appropriate, including proceeding to court,” he said.

      NSW Police said the majority of low-level drug offenders who attend court receive a fine yet do not receive any incentive to take up health advice.

      It is anticipated the scheme will begin early next year.
